Marrakech Design – International Purchase Conditions

Version: October 2026

Applicable to orders with a final destination outside Sweden

These International Purchase Conditions apply to purchases from Marrakech Design where the final destination of the goods is outside Sweden. This applies regardless of the customer’s country of residence or establishment, billing address, nationality or the language used in communication.

These Purchase Conditions also apply where the goods are collected from Marrakech Design’s warehouse in Sweden by the customer, or by a carrier, freight forwarder or other third party appointed by the customer, for onward transport to a destination outside Sweden.

Purchases where the final destination of the goods is Sweden are governed by Marrakech Design’s Swedish Purchase Conditions.

Where the customer is a consumer, nothing in these Purchase Conditions limits any mandatory consumer rights that apply under applicable law. Where the customer is acting for purposes relating to a trade, business or profession, the customer is considered a Business Customer.

1. Placing Orders and Purchase Agreement

Orders for tiles and other larger quantities are normally placed by email following a quotation from Marrakech Design. Samples and selected care products may also be purchased through our website.

For orders placed by email, Marrakech Design confirms the order by issuing an invoice. The invoice constitutes the formal order confirmation and specifies the products, quantities, prices, delivery charges and other relevant order details. The invoice, together with these Purchase Conditions and any applicable quotation, forms the basis of the agreement.

By proceeding with payment of the invoice, the customer confirms the order and accepts these Purchase Conditions.

The customer is responsible for verifying that the products, colours, sizes, quantities, delivery details and any customer-specific specifications stated in the quotation and invoice are correct before payment and, where applicable, before production begins.

Where Marrakech Design assists in estimating quantities based on measurements, drawings or other information supplied by the customer, such calculations are provided as guidance only. The final quantity required for the project must be verified by the customer and, where appropriate, by the architect, designer, contractor or installer.

We recommend ordering an additional 10–15% to allow for cuts, wastage and future replacements.

Marrakech Design does not offer a general right to return or repurchase surplus material. Tiles remaining after installation, or which the customer no longer requires, are therefore not accepted for return, even if the boxes are unopened.

This applies regardless of whether the order was placed remotely or the goods were collected from our warehouse. However, this does not affect any statutory right of withdrawal or other mandatory consumer rights under applicable law. See Section 10.

2. Payment

Payment can be made by bank transfer, card payment via a secure payment link, or Apple Pay where available. Customers with access to Swish may also pay via Swish.

Full payment must be received before dispatch unless otherwise agreed in writing. Payment details and available payment methods will be stated in the quotation, invoice or payment instructions. International bank transfers may take several business days to reach our account.

For made-to-order and custom-made products, a deposit of normally 50% of the order value is required before production begins, unless otherwise stated in the quotation or invoice. Production will not begin until the required deposit has been received. The remaining balance must be paid before dispatch unless otherwise agreed in writing.

The invoice is valid until the due date stated on the invoice. If payment is not received by the due date, Marrakech Design reserves the right to cancel the order or issue an updated invoice. Product availability, prices and delivery terms may need to be reconfirmed before a new or updated invoice is issued.

3. Prices, VAT, Customs Duties and Import Charges

Prices, currencies, VAT treatment and freight charges are stated in the applicable quotation, invoice or website checkout.

For deliveries outside the European Union, Swedish VAT will normally not be charged where the legal requirements for export are met. Local VAT, customs duties, import taxes, clearance charges and other fees may be payable by the customer upon import unless expressly stated otherwise.

Marrakech Design may correct obvious typographical, calculation or pricing errors and update product information before the invoice is issued. Once the invoice has been issued, the stated price applies unless an obvious error has occurred or the parties agree otherwise.

Stock levels and product availability may occasionally be incorrect. If a product is not available in the quantity ordered, Marrakech Design will contact the customer as soon as possible. Where possible, the customer will be offered an alternative solution or a refund for the part of the order that cannot be supplied.

4. Handmade Products, Samples and Batch Variations

Our cement and zellige tiles are handmade. Natural variations in colour, shade, texture, surface, edges and dimensions are inherent characteristics of the products and are part of their intended appearance.

Samples are indicative only. Variations may occur between a sample and the final production batch, and between separate production batches. Colours may also appear different depending on lighting conditions, photography and screen settings.

We recommend ordering a physical sample before placing a larger order. If an order is placed without first viewing a sample, the customer acknowledges that colours, shades, textures and other handmade characteristics may differ from photographs and digital representations.

Exact colour matching between separate orders placed at different times cannot be guaranteed. We recommend mixing tiles from different boxes during installation to achieve a balanced and natural appearance.

5. Order Planning and Delivery

Customers should place orders well in advance to allow sufficient time for production, transport, customs clearance, delivery and inspection before installation.

Estimated delivery times will be stated where possible. Delivery times are estimates unless a specific delivery date has expressly been agreed in writing. Delays may occur due to freight carriers, customs procedures, weather, production or other circumstances outside Marrakech Design’s reasonable control.

Deliveries are made to the agreed delivery address. For pallet deliveries, delivery is made to the nearest point at the delivery address that can reasonably and safely be accessed by the carrier and its delivery vehicle. The pallet is unloaded at this point. Delivery does not include carrying or moving the goods into a house, apartment, building, courtyard or other premises. The customer is responsible for moving the goods from the delivery point.

The customer is responsible for informing Marrakech Design before dispatch of any known access restrictions that may affect delivery, such as narrow roads, restricted vehicle access or other conditions that may prevent normal freight delivery. Additional costs resulting from access restrictions that were not communicated before dispatch may be charged to the customer.

Additional charges may apply for requested time windows, storage, re-delivery, address changes or other changes requested after dispatch.

Please do not schedule installers or contractors until the goods have been delivered and inspected. Marrakech Design is not responsible for installation or rescheduling costs resulting from appointments arranged before delivery and inspection.

6. Failure to Accept Delivery

If delivery cannot be completed because the customer does not accept or arrange receipt of the shipment, the customer may be responsible for reasonable storage, return freight and re- delivery costs actually incurred as a result.

7. Receipt of Goods and Transport Damage

Customers are requested to inspect the shipment as soon as reasonably possible after delivery and verify that the product, quantity, colour and apparent condition correspond to the order.

Visible transport damage should be noted with the carrier at delivery and documented with photographs. Transport damage, missing goods or incorrect deliveries should be reported to Marrakech Design in writing within seven (7) days, so that we can process the matter efficiently with the carrier.

In the event of transport damage, the customer should retain the damaged goods and all relevant packaging until the claim has been assessed. The customer should provide clear photographs showing the damaged goods, the pallet and packaging, together with information about the quantity affected.

8. Inspection Before Installation

All products must be carefully inspected before installation. The customer should verify that the products, quantities, colours and apparent condition correspond to the order.

Any product with a visible defect or damage, such as a crack or significant chip, must not be installed. If an issue is identified, the customer should contact Marrakech Design before installation.

Handmade variations described in these Purchase Conditions and in the relevant product information are inherent characteristics of the products and are not in themselves considered defects.

9. Installation, Treatment and Storage

Products must be stored in a dry, frost-free environment before installation.

Please note that newly manufactured tiles, particularly orders shipped directly from the factory, may still contain moisture when delivered. Both the tiles and their packaging may therefore feel damp upon arrival. This is normal for newly manufactured handmade tiles and is not in itself a product defect.

We recommend unpacking the tiles as soon as possible after delivery and allowing them to air in a dry, well-ventilated environment. This allows excess moisture to evaporate and helps speed up the natural drying process. The tiles do not need to be completely dry before installation and may be installed while still damp.

Marrakech Design recommends that installation is carried out by experienced professionals familiar with handmade cement and zellige tiles. Products should be installed, sealed, treated and maintained in accordance with the applicable Marrakech Design installation and care instructions.

Marrakech Design is not responsible for damage caused by incorrect installation, cutting, sealing, treatment, maintenance, cleaning or refinishing carried out by the customer or a third party.

10. Right of Withdrawal – Consumers

This section applies only to consumers where a statutory right of withdrawal applies. It does not apply to Business Customers.

For consumers in the European Union, remote purchases are generally subject to a fourteen (14) day right of withdrawal from receipt of the goods, subject to applicable law and statutory exceptions. Consumers in other countries may have different mandatory rights.

To exercise a right of withdrawal, the consumer must notify Marrakech Design clearly in writing within the applicable withdrawal period. Prior approval from Marrakech Design is not required, but the customer should contact us before returning goods so that we can provide practical return instructions.

Where applicable, a consumer may withdraw from all or part of an order. Goods must be returned without undue delay and within the period required by applicable law.

The customer is responsible for the direct cost of returning the goods.

For returns from within the European Union that require pallet transport, the return shipping cost is estimated at a maximum of approximately EUR 800 including VAT. The actual cost will depend on the destination, weight, shipment size and carrier and may therefore be lower.

Where Marrakech Design arranges the return transport, the exact cost will be communicated to the customer for approval before the return is booked.

Customer is responsible for arranging and paying for the return shipment.

Returned goods must be packed and secured in a manner that provides sufficient protection during return transport. For palletised returns, the customer is responsible for ensuring that the goods are safely packed, secured to the pallet and suitably protected for transport.

If the original packaging, pallet, pallet collar or other transport packaging is no longer available, the customer is responsible for arranging and paying for equivalent suitable packaging to ensure that the goods can be returned safely.

The customer should retain proof of shipment until the return and refund have been completed.

Customer may be responsible for loss or damage resulting from insufficient or negligent packaging, incorrect addressing or other negligent handling of the return.

The consumer may also be responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and condition of the goods.

Where the entire order is validly withdrawn, Marrakech Design will reimburse the amounts including the cost of the least expensive standard delivery offered where required. Additional delivery costs resulting from the customer choosing a more expensive delivery method are not refundable.

For a partial withdrawal, the original delivery cost is not normally refunded.

Refunds will be made within the period required by applicable law. Marrakech Design may withhold reimbursement until the returned goods have been received or the customer has provided evidence that the goods have been sent back, whichever occurs first.

Samples and care products purchased online are subject to any statutory right of withdrawal that applies.

If a product has been opened, used or handled beyond what is necessary to inspect it, Marrakech Design reserves the right to make a deduction for any resulting diminished value.

11. Made-to-Order and Custom-Made Products

Products that are not held in stock and are ordered or manufactured specifically following a customer's order, as well as products made according to the customer's individual requirements, are subject to Marrakech Design's terms for made-to-order products.

A 50% deposit is normally required for these products before the order is placed or production begins, unless otherwise agreed. The remaining balance must be paid in full before delivery or collection.

Orders for these products are binding, and Marrakech Design does not offer cancellations, returns or repurchases once the order has been confirmed.

In the event of cancellation, the deposit paid may be retained in full or in part to cover costs and losses incurred as a result of the order.

Changes to an order after production has started may be limited. Any changes must be approved by Marrakech Design and may result in additional costs and revised delivery times.

12. Returns by Business Customers

Business Customers do not have a consumer right of withdrawal. Orders placed by Business Customers are binding, and Marrakech Design does not accept returns of correctly supplied products because the products are no longer required, quantities have been overestimated, or the customer has changed their mind.

This applies to products held in stock as well as made-to-order and custom-made products. Deposits, cancellations and other terms relating specifically to made-to-order and custom- made products are governed by Section 11 above and the applicable quotation and invoice.

This does not affect the Business Customer’s right to make a claim concerning defective, damaged or incorrectly delivered goods in accordance with these Purchase Conditions and applicable law. Such matters are handled as complaints and are addressed separately under Complaints and Defective Goods.

13. Complaints and Defective Goods

If a customer wishes to make a complaint regarding a defective, damaged or incorrectly supplied product, the customer should contact Marrakech Design in writing as soon as reasonably possible.

A complaint should include the invoice number, a description of the issue and clear photographs showing the affected products. Marrakech Design may request additional photographs or information reasonably necessary to assess the complaint. The affected products should be retained until the complaint has been assessed, unless Marrakech Design confirms otherwise.

The customer should give Marrakech Design a reasonable opportunity to assess the complaint and, where relevant, inspect the affected goods before further action is taken.

As stated in Section 8, products with visible defects or damage must not be installed.

Marrakech Design is not responsible for damage or deterioration caused after delivery by installation, cutting, handling, storage, sealing, treatment, grouting, cleaning or maintenance; the use of unsuitable products or chemicals; normal wear and tear; movement, moisture or other conditions in the underlying construction; or work carried out by the customer, installer or another third party.

Natural variations in colour, shade, texture, surface, edges and dimensions inherent to handmade cement and zellige tiles and described in the product information are not considered defects.

Where an issue is reported after installation, Marrakech Design may require information and documentation regarding the installation, substrate, materials used, treatment, maintenance and other relevant circumstances to assess whether the issue relates to the product itself or has arisen after delivery.

14. Collection and Customer-Arranged Transport

Customers may collect their order directly from Marrakech Design’s warehouse using their own vehicle. Collection must be arranged and confirmed in advance.

The customer is responsible for ensuring that the vehicle used for collection is suitable for the size and weight of the order and that the goods can be transported safely.

Customers may also arrange collection through their own carrier, freight forwarder or other third party. In such cases, the customer is responsible for arranging the collection and for any related transport costs.

Where agreed in advance, collection may take place when Marrakech Design staff are not present. The order will be prepared and made available for collection, and access instructions may be provided to the customer or the person collecting on their behalf.

Once the prepared order has been collected by the customer or by a carrier, freight forwarder or other third party independently appointed by the customer, Marrakech Design is not responsible for loss or damage occurring during subsequent handling, transport or unloading.

The customer should inspect the goods as soon as reasonably possible after collection and report any visible damage, discrepancy or incorrect goods to Marrakech Design without undue delay.

15. Limitation of Liability – Business Customers

This section applies only to Business Customers.

Marrakech Design is not liable for indirect or consequential losses arising from the purchase, delivery or use of the products, including loss of profit, revenue, business, production or anticipated savings.

Marrakech Design is not responsible for costs or losses resulting from installation work, contractors or other services being scheduled before the products have been delivered and inspected.

16. Force Majeure

Marrakech Design is not responsible for delays or failure to fulfil an obligation where this is caused by circumstances beyond our reasonable control.

Such circumstances may include, but are not limited to, natural disasters, fire, flood, war, terrorism, civil unrest, strikes or other labour disputes, government actions or restrictions, changes in law or regulations, customs delays, major transport disruptions, port closures, shipping disruptions, shortages of materials or energy, or significant disruptions affecting our suppliers, manufacturers or transport providers.

In the event of such circumstances, Marrakech Design is entitled to a reasonable extension of time to fulfil the affected obligation.

If the circumstances continue for an extended period and the order can no longer reasonably be fulfilled, Marrakech Design or the customer may cancel the affected part of the order, subject to any mandatory rights and obligations under applicable law.

17. Personal Data

Marrakech Design processes personal data in accordance with applicable data protection legislation and our Privacy Policy.

Personal data may be processed where necessary to manage orders, payments, deliveries, customer service and other matters related to the purchase.

18. Governing Law and Disputes

These Purchase Conditions and purchases from Marrakech Design are governed by Swedish law. In the event of a dispute, the customer should first contact Marrakech Design so that we can attempt to resolve the matter directly. Any dispute that cannot be resolved between the parties will be handled by the Swedish court.

For Business Customers, disputes shall be governed by Swedish law and, unless otherwise agreed in writing, shall be subject to the jurisdiction of the Swedish courts.

19. Severability

If any part of these Purchase Conditions is found to be invalid or unenforceable under applicable law, the remaining terms will continue to apply.
